This petition has been filed seeking a relief for direction to the Civil Judge (Junior Division), Garvi, Allahabad to decide the application (6-C) filed by the petitioner in Original Suit No. 715 of 2016 (Smt. Pyari Devi and others Vs. Vinod Kumar and another) within a stipulated period.
Record reveals that a suit for permanent injunction was filed by the plaintiff-petitioner and two others against the defendant- respondent nos. 2 and 3. The application under Order 39 Rule 1 C.P.C was filed in the court below in 2016 itself but it is stated that as yet the said application 6-C continues to be pending.
Given the facts and circumstances of the case, I deem it appropriate to direct the Civil Judge (Junior Division), Garvi, Allahabad to decide the application 6-C, expeditiously after hearing the defendants in the matter.
With the aforesaid observations, this petition is disposed of.
