As per office report dated 12.9.2018, learned counsel for the revisionist has not taken steps for service of notice on opposite party Nos.2 to 6. Vide order dated 29.3.2017 learned counsel for the revisionist was directed to take steps for service of notice on opposite party Nos.2 to 6, which has not been complied.
List revised.
None appears on behalf of the revisionist to press this revision.
This revision is directed against the order dated 12.4.2006 passed by the Additional District and Sessions Judge, FTC-2, Budaun in S.T. No.259 of 2005, whereby opposite party Nos.2 to 6 have been acquitted by the court below for the offence under Sections 323, 325, 504, IPC.
A perusal of the order passed by the court below shows that the injured witness, Badan Singh was not examined before the trial court and other important witnesses were also not produced for proving the prosecution case. The case has been falsely filed only for defending in the cross case by the informant. The court below has disbelieved the case of the prosecution and has acquitted the accused. The order of the court below does not appears to suffer from any legal infirmity and calling for any interference in exercise of revisional power of this Court.
