The petitioner is aggrieved by the provisional assessment of electricity dues vide assessment order dated 19.1.2018 of the Executive Engineer Vidut Vitran Khand Chaturth Dakshinachal Vidut Vitran Nigam Limited, Hathras.
The petitioner against the aforesaid provisional assessment has a remedy of filing objections whereupon final assessment will be done and against the final assessment if he is aggrieved, he may prefer an appeal under Section 127 of the Electricity Act, 2003.
In view of the above alternative remedies available to the petitioner, it is not proper for this Court to exercise its discretionary jurisdiction. Moreover, the petitioner has also filed a suit for permanent injunction restraining the respodnents from recovering the electricity dues as per the aforesaid provisional assessment.
Accordingly, we decline to exercise our discretionary jurisdiction and the petition is dismissed.
