Heard learned counsel for the petitioner and learned Standing Counsel representing respondent nos.1 to 4.
Present writ petition has been filed beseeching writ of mandamus commanding the Deputy Director of Consolidation, Mau (respondent no.2) to implement the order dated 31.05.2013 in the revenue record.
It is submitted by learned counsel for the petitioner that vide order dated 31.05.2013 (Annexure-3) passed by the respondent no.2, matter has been decided in favour of the petitioner. For compliance of the aforesaid order dated 31.05.2013, petitioner has moved several representation to the authorities concerned including the respondent no.2 but till date nothing has been decided on the aforesaid representations. After the date of passing the order, petitioner is running from pillar to post to get the matter decided, but matter is protracted for one or the other reason.
Learned Standing Counsel states that he has no objection if this Court issues any direction for disposal of the pending application.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the writ petition, with a direction that petitioner is at liberty to move fresh representation, within period of three weeks from today, qua her grievances as mentioned in the present writ petition along with copy of this order before the Deputy Director of Consolidation, Mau (respondent no.2), who shall either decide the same himself or direct the other authority concerned to take appropriate decision, under the relevant provision of law as applicable expeditiously, preferably, within the period of three months from the date in receipt of the aforesaid representation.
The petitioner shall file a computer generated copy of this order downloaded from the official website of High Court, Allahabad, supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court, Allahabad.
With the aforesaid observations, this petition is finally disposed of.
