This application u/s 482 Cr.P.C. has been moved on behalf of applicant seeking the quashing of order dated 24.01.2018 passed by the Chief Judicial Magistrate, Kannauj as well as entire criminal proceeding of Complaint Case No.1438 of 2015 (Pushpa Devi vs. Anil Kumar and others), u/s 420, 467, 468 I.P.C., P.S.-Kannauj, District-Kannauj.
Heard learned counsel for the applicant and learned A.G.A. and also perused the record.
Counsel for the applicant has not been able to point out any such illegality much less than any abuse of court's process which may persuade this Court to interfere in the impugned order or proceeding. It may be observed that in appropriate cases this Court in exercise of its inherent jurisdiction may proceed to quash some criminal prosecution when it feels that there is chance of any fruitful conclusion and the matter has been amicably settled in between the parties and the nature of litigation is such which is confined in its consequences to the parties and has no wider ramification affecting the society at large. But that does not mean that the trial court can also exercise the same power. The compounding of offences can be done strictly in accordance with the schedule chart provided under the Code of Criminal Procedure.
The application lacks merit and therefore same stands dismissed.
