The contention of learned counsel for the petitioner is that on mere non-payment of potato dues if a person commits suicide it cannot be said that the persons who committed default in making payment would be liable for offence of abetment of suicide.
Matter requires consideration.
Learned A.G.A. has accepted notice on behalf of respondent nos. 1 & 2.
Let notice be issued to respondent no. 3 fixing 30th May, 2019.
List the petition on 30th May, 2019. By the next date, the respondents shall file their respective counter affidavits.
Till the next date of listing or till submission of police report under section 173 (2) Cr.P.C., whichever is earlier, the petitioners shall not be arrested in Case Crime No. 0161 of 2019, under Sections 306 I.P.C., Police Station Kotwali Gursahaiganj, District Kannauj, subject to petitioners' co-operation in the investigation.
It is made clear that this Court has not stayed the investigation of the aforesaid case.
