Heard Sri Uma Dutt, Advocate, holding brief of Sri Sanjai Singh, learned counsel for the petitioner and Sri B.P. Singh Kachhawah, learned Standing Counsel for the State.
The instant petition has been filed with a prayer to direct the District Magistrate, District-Firozabad to decide Case No. 00953 of 2021 (Punjab National Bank Vs. M/S Firozabad Ceramics Pvt. Ltd. & Ors.) filed on 06.04.2021, under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, within the stipulated period.
The said proceedings are stated to be pending before the District Magistrate, Firozabad, respondent no.2.
Since the proceedings are pending for more than three months, the present writ petition is disposed of with a direction that in case the petitioner files a copy of this order alongwith the application dated 6.4.2021 (Annexure-3 to the writ petition) before respondent no.2 within a period of two weeks from today, the said authority shall pass an appropriate order on the said application as expeditiously as possible without any unnecessary delay, if there is no legal impediment.
