Shri L.B. Dabhi, learned APP waives service of notice of rule on behalf of respondent no. 1.
2. The present application has been preferred by the applicants-original respondents nos. 2 and 3 for fixing the early date of hearing of Criminal Miscellaneous Application No. 3835/2009. Though the copy is served upon the learned advocate appearing on behalf of respondent no. 2 and his name is shown on board, the learned advocate appearing on behalf of respondent no. 2 has chosen to remain absent.
3. Having heard Shri C.J. Vin, learned advocate appearing on behalf of the applicants and Shri L.B. Dabhi, learned APP appearing on behalf of respondent no. 1 and considering the facts and circumstances of the case, Registry is directed to notify Criminal Miscellaneous Application No. 3835/2009 on 28/02/2012. Rule is made absolute accordingly.
