Sri Kartikeya Saran has put in appearance on behalf of respondent no. 12 and Sri Ved Byas Mishra for the respondent no.8.
From the record, it is more than apparent that the petitioner was terminated vide order dated 9.8.1999 on an enquiry was conducted by the competent authority.
The charges levelled against the petitioner were found proved in the departmental enquiry. It was proceeded exparte as the petitioner did not participate.
After a period of 19 years, the petitioner cannot be permitted to challenge the decision taken by the competent authority on the ground that no opportunity of hearing had been provided to the petitioner. Admittedly, the petitioner is not in service from the year 1999, the claim of the petitioner for reinstatement and payment of retiral dues has been rejected vide order dated 11 October, 2017 by respondent no.6, namely, Additional Director Social Welfare, Kalyan Bhawan Lucknow, which does not call for any interference.
For the above noted reasons and facts, this Court finds that the writ petition is wholly misconceived. Dismissed as such.
