Be that as it may without entering into merits of the claim of the petitioner, the present petition is disposed of with the direction to the court concerned to decide the recall application no.100 of 2008 (Professor Shibban Lal Saxena Smarak Maharajganj vs. Aniruddha and others) pending in the court of learned Civil Judge(JD), Maharajganj in Original Suit No.270 of 2002, as expeditiously as possible, without granting any unnecessary adjournment to any of the parties.
