JUDGMENT / ORDER

Rule.
Mr. J.K. Shah, learned APP appearing on behalf of the State waives service of Rule.
This is an application for modification of condition No.4 imposed by this Court vide order dated 10.5.2011 in Criminal Misc. Application No. 5977 of 2011. The accused applicant herein was arrested in connection with an offence registered with Kotda Sangani Police Station, Dist. Rajkot vide C.R No. I-96 of 2008 for the offences punishable under Sections 405, 406, 409, 420, 465, 467, 471, 477(1), 120(B) and 114 of IPC and Section 13(2) of the Prevention of Corruption Act, 1988. This Court vide order dated 10.5.2011 passed in Criminal Misc. Application No. 5977 of 2011, ordered release of the accused applicant on bail pending trial, subject to certain terms and conditions, one of the terms and conditions imposed at the relevant point of time was that the accused applicant shall mark his presence before the concerned Police Station on every 2nd and 4th Sunday of every month between 10.00 AM to 2.00 P.M.
By way of this application it is prayed that condition No.4 which was imposed earlier may be deleted as accused applicant has been once again reinstated in service at Gandhinagar. It is further averred that the distance between the place of residence and the concerned Police Station is around 275 K.M. Be that as it may, the fact is that almost one year has elapsed since the time the accused applicant was ordered to be released on regular bail. It is reported that he is attending the Court of Special Judge before whom the trial is pending and the trial is also now ripe for hearing. In this view of the matter, the application deserves to be accepted and the same is hereby allowed. Condition No.4 imposed by this Court in Criminal Misc. Application No. 5977 of 2011 in so far as it directed the accused applicant to mark his presence before the concerned Police Station stands deleted. All other conditions shall remain as the same and the accused applicant shall abide the same scrupulously. Rule is made absolute. Direct service permitted.
