In Re: Writ Petition Heard learned counsel for the petitioner, learned Standing Counsel appearing for the State respondents and Sri Pradeep Singh, learned counsel appearing for Gaon Sabha.
Present petition has been filed with a prayer that the Sub Divisional Magistrate, Bhadohi, District Bhadohi be directed to decide case no. 02247 of 2019, computer case no. T201916670502247 (Premchandra v. Ramcharan and others) under section 116 of U.P. Revenue Code, 2006 within stipulated period.
Perusal of the ordersheet shows sorry state of affairs, as on most of the dates lawyers were abstaining from work, it is only on few dates the case was proceeded.
However, in the interest of justice, the present petition is finally disposed of with the direction to the Sub Divisional Magistrate, Bhadohi, District Bhadohi to expedite the hearing of the aforesaid case and decide the same, in accordance with law, expeditiously, preferably within a period of one year from the date of production of a self verified copy of this order before him provided the functioning of the court is not affected by any reason related to COVID-19 Pandemic, the advocates are not abstaining from work and there is no other legal impediment.
With the aforesaid observations/ directions, the present petition is finally disposed of.
