Heard learned counsel for the parties.
This application u/s 482 of the Code of Criminal Procedure, 1973 is directed against the order of criminal procedure pursuant to the charge sheet dated 14th March, 2018 in Case No. 1371 of 2018 arising out of Case Crime No.488 of 2017, under Sections 419, 420, 467, 468, 471, 504, 506 I.P.C., Police Station- Chhibramau, District- Kannauj.
Having perused the charge sheet and the statement recorded under Section 161 Cr.P.C., this Court declined to interfere with the matter in respect of the applicant Nos. 2 and 3.
Considering the age of the applicant No.1 being lady matter requires consideration for grant of interim bail.
In respect of the applicant Nos. 2 and 3 this application stands disposed of with the direction that they may apply for bail and in the event they surrender/ apply for bail within 30 days from today, their bail applications shall be considered in accordance with the settled principles laid down by the Full Bench of this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgement passed by Hon'ble Apex Court reported in 2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs. State of U.P.
However, in respect of the applicant No.1 this application also stands disposed with the direction that the applicant No.1 will be on interim bail till the disposal of the final bail application and the applicant No.1 is directed to apply for proper bail through the counsel within 30 days from today in the event such application for bail is filed, the same shall be disposed of within next two weeks finally in the light of the law laid down in above quoted judgments.
