Heard counsel for the petitioner and learned standing counsel.
By this petition, the petitioner seeks a writ in the nature of mandamus commanding the respondent no. 1-Consolidation Officer, Khalilabad, Sant Kabir Nagar to decide pending Case No. 1155 to 1158, Ram Surat Vs. State, within a reasonable period of time.
Contention of the learned counsel for petitioner is that vide order dated 26.7.2017, the Deputy Director of Consolidation allowed the revision filed by the petitioner by setting aside the orders dated 23.4.2011 and 24.11.1990 passed by the Settlement Officer Consolidation & Consolidation Officer respectively and the matter was remanded to the Consolidation Officer for decision afresh within two months after giving opportunity of hearing to the parties. It is further contended that though a year has elapsed since then but no decision has been taken by the Consolidation Officer.
In the facts and circumstances of the case, a direction is issued upon respondent no. 1-Consolidation Officer, Khalilabad, Sant Kabir Nagar to decide pending Case No. 1155 to 1158, Ram Surat Vs. State, in accordance with law expeditiously within six months from the date of production of a certified copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
