By way of instant appeal, challenge has been made to the validity and sustainability of the judgment and order of conviction dated 17.9.1991 passed by Additional Asst. Session Judge, Etah in Session Trial No.96 of 1991 (State Vs. Prem Singh), under Section-307 I.P.C., Police Station-Jalesar, District-Etah, whereby, the appellant was sentenced to eight years rigorous imprisonment.
In compliance of the order dated 2.2.2018 passed by the Court, Chief Judicial Magistrate, Agra has reported vide letter dated 24.8.2018 that sole appellant-Prem Singh has since expired.
In view of above, this appeal is liable to be dismissed as abated. The present appeal is, accordingly, dismissed.
