Heard learned counsel for the petitioner and Sri Ajeet Kumar, learned Standing Counsel for the respondents.
The petitioner has preferred this petition with a prayer to issue a mandamus directing the respondent no.3/Consolidation Officer, Ram Nagar Bharsara, Jaunpur to decide the application submitted by him under Section 9-A C.H. Act of 1953 expeditiously within a stipulated period.
It is argued by learned counsel for the petitioner that aforesaid application is pending consideration before the respondent no.3 since 2017.
Sri Ajeet Kumar, learned Standing Counsel for the respondents very fairly argued that in the facts and circumstances of the case direction could be given to the respondent no.3 to decide the application submitted by the petitioner within a time bound period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to the respondent no.3/Consolidation Officer, Ram Nagar Bharsara, Jaunpur to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of six months from the date of production of certified copy of this order but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost.
