Heard Sri Ramesh Chandra Gupta 2, learned counsel for the petitioners and Sri G.P. Singh, learned A.G.A. for the State.
This writ petition has been filed for quashing the order dated 17.09.2018 passed by Additional Sessions Judge-IVth/Special Judge E.C. Act in criminal revision no. 53 of 2017 as well as order dated 30.01.2017 passed by Additional Chief Judicial Magistrate, C. No. 14, Fatehpur in complaint case no. 2283 of 2015, P.S. Bindki, district Fatehpur.
The contention of the learned counsel for the petitioners is that no offence against the petitioners is disclosed and the present prosecution has been instituted with mala fide intention for the purposes of harassment. He pointed out certain documents and statements in support of his contention. It is further contended that the order impugned has been passed without application of mind and is liable to be quashed.
After hearing the learned counsel for the petitioners, learned A.G.A. and after perusing the order impugned as well averments made in the instant petition, this Court is of the opinion, that learned counsel for the petitioners could not point out any legal infirmity in the order impugned which may warrant any interference by this Court and accordingly, the instant writ petition lacks merit and is dismissed.
