Heard learned counsel for the petitioner and perused the record.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"(i) direct the Civil Judge Garvi (S.D.) Kanpur Nagar to decide the 6-C application filed in Original Suit No. 989 of 2020 (Prem Chand and another vs. Arvind Kumar & another) expeditiously within stipulated period directing to the parties concerned to maintain status quo over the property in dispute till disposal of 6-C application before the court below."
It is submitted that the 6-C application has remained pending.
Sri Shivam Yadav, learned counsel for the respondent has no objection, if a direction is issued for time bound disposal of 6-C application.
Considering the overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid 6-C application strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of 60 days positively from the date of production of copy of this order.
Copy of the order available on the official website of the High Court will be taken to be authentic one.
