The sole prayer made in the instant petition is for issuing direction to the court below to decide Execution Case No.161 of 2017, expeditiously, within specified time frame.
An award passed by the Arbitrator is under execution. It is specifically stated that no objection under Section 34 of Arbitration and Conciliation Act, 1996 was filed and therefore, the award has attained finality.
Supplementary affidavit has been filed stating that objection under Section 47 C.P.C. has also not been filed.
Having regard to the facts of the case, the instant petition stands disposed of with direction to the court below to ensure that the execution proceedings are taken to their logical end, expeditiously, by fixing short dates.
