JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE A.L.DAVE) Rule.
Learned APP Mrs.Shah waives service of notice of rule on behalf of the respondent State.
The applicant seeks temporary bail on the ground of his own ailment in the form of undescended testis on right side. He has produced the medical certificate issued by the Medical Officer, Vadodara Central Jail, Vadodara which confirms the ailment. It is also stated in the said certificate that undescended testis may prove to be site of cancer in future. In this set of circumstances, this application is allowed in part.
The applicant is, therefore, ordered to be released on temporary bail for a period of 03 (THREE) WEEKS from the date of his actual release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) before the Jail Authorities. The applicant shall surrender before the Jail Authorities in time.
Rule is made absolute to the aforesaid extent.
