Supplementary affidavit filed on behalf of applicants is taken on record. Short counter affidavit filed on behalf of opposite party nos. 2 and 3 Sushil Kumar Pandey and Smt. Soniya is also taken on record.
Heard learned counsel for the applicants and the learned A.G.A., and learned counsel for the opposite party Nos. 2 and 3.
This application under Section 482 Cr.P.C has been filed for quashing the proceedings of Case No. 671 of 2014 (Sushil Kumar Pandey vs. Prashant Mishra and others), under Sections 498-A IPC and Section 3/4 D.P. Act, P.S. Panki, District Kanpur Nagar pending in the court of A.C.J.M.-II, Kanpur Nagar.
This is a matrimonial dispute. Opposite party no.2 Sushil Kumar Pandey and opposite party no. 3 Smt. Soniya wife of Prashant Mishra, applicant no. 1 have filed a short counter affidavit with assertion that matter has been settled.
In this case, matter has been settled between the parties, therefore, no fruitful purpose would be served in keeping this matter pending any further.
In view of the law laid down by Hon'ble Apex Court in the case of Social Action Forum for Manav Adhikar and Another Vs. Union of India reported in 2018 SCC Online SC 1501, the entire proceedings of Case No. 671 of 2014 (Sushil Kumar Pandey vs. Prashant Mishra and others), under Sections 498-A IPC and Section 3/4 D.P. Act, P.S. Panki, District Kanpur Nagar pending in the court of A.C.J.M.-II, Kanpur Nagar is hereby quashed.
Accordingly application under Section 482 Cr.P.C., is allowed.
