Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 09 of 2017, under Section 302 IPC, P.S. Kotwali Orai, District Jalaun, is seeking enlargement on bail during the trial.
Keeping in view that there is dying declaration of the deceased and the applicant is languishing in jail since 12.01.2017 and the bail application of the applicant was rejected April 2017. Applicant is the sole accused, post mortem report supports the allegation of the FIR. No case for enlarging the applicant is made out.
After having heard the submissions advanced by learned counsel for the parties and perused the material brought on record. I am not inclined to enlarge the applicant on bail, accordingly, the bail application is hereby rejected. However considering the peculiar facts and circumstances of the case the trial court is directed to conclude the trial of the applicant within a period of one year from the date of production of certified copy of this order without granting unnecessary adjournments to either of the parties.
Subject to aforesaid direction, this application is disposed of.
