Application for bail under Sec.438 of Cr.P.C. 2. Petitioners are accused nos.1 to 3 in Crime No.1578 of 2014 of Thodupuzha Police station registered for offences punishable under Secs.323, 324, 308 and 294 (b) read with Sec.34 of IPC.
3. Prosecution allegation is that on 02.09.2014 at about 4 p.m., the accused persons attacked the defacto complainant with an iron rod, causing injury on the back of his head.
4. Heard the learned counsel for the petitioners and the learned Public Prosecutor.
5. It is submitted that this case is a counter blast of Crime No.1576 of 2014 of the same Police station.
B.A. No.7029 of 2014 is pending therein.
6. Learned counsel appearing for the petitioners in the bail applications submitted that the parties are neighbours and they have almost settled the issues on a talk. Therefore bail is granted to the Bail Appl. No.6984 of 2014 2 petitioners with the following conditions.
1. The petitioners shall surrender before the investigating officer and submit themselves for interrogation. Thereafter, they shall be released by the investigating officer on bail on their executing bond for Rs.25,000/- (Rupees twenty five thousand only) each with two solvent sureties each for the like sum to the satisfaction of the Investigating officer.
2. The petitioners shall appear before the investigating officer as and when directed for interrogation.
3. The petitioners shall not intimidate or influence the witnesses.
