Notice for final disposal, returnable on 31st January, 2012, as the learned advocate for the petitioner has contended the instance for production of B.U.Permission for the extension of class, is wholly unreasonable.
In view of peculiar fact, the school is housed in the building which is 68 years old and in such building there exists no requirement of issuance of B.U.Permission, rather it has certificate of engineer about the structural stability, which is already produced. In view of this, respondents are hereby called upon to explain their conduct by the returnable date. Therefore, notice is issued for final disposal. The respondents are at liberty to file their affidavit in reply on or before returnable date i.e. 31st January, 2012.
