Heard learned counsel for the appellant and learned A.G.A. for the State.
By way of instant appeal, challenge has been made to the validity and sustainability of the judgment and order of conviction dated 4.2.1991 passed by Special Judge/Additional Sessions Judge, Meerut in E.C. Case No. 6 of 1987 (State Vs. Prakash Chand), under Section 3/7 Essential Commodities Act, Police Station-Chaprauli, District-Meerut, whereby, the appellant was sentenced to three months rigorous imprisonment coupled with fine Rs.500/- with default stipulation to suffer additional rigorous imprisonment for 1-1/2 months.
In compliance of the order dated 13.2.2018 passed by the Court, Chief Judicial Magistrate, Meerut has reported vide letter dated 25.4.2018 that sole appellant-Prakash Chandra has since expired.
In view of above, this appeal is liable to be dismissed as abated. The present appeal is, accordingly, dismissed.
