The learned counsel for the petitioners in CRP(MD)No.957/2017 submits that the Trial Court did not proceed further with I.A.No.401/2014 in view of pendency of CRP(MD)No.1248/2013 pending on the file of this Court. Therefore, he seeks a direction to the Trial Court to dispose of I.A.No.401/2014 in O.S.No.82/1124 ME (1949) on the file of the Principal Sub Court, Nagercoil, within a time frame to be fixed by this Court.
2.Today, the counsel representing the revision petitioners in CRP(MD)No.1248/2013 sought permission of this Court to withdraw this revision. He has also made an endorsement to that effect. Recording the submission and endorsement, CRP(MD)No.1248/2013 is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petitions are closed.
3.Therefore, there is no impediment for the Court below to take up I.A.No.401/2014 and dispose of it at the earliest. Hence, CRP(MD)No.957/2017 is disposed of taking note of the dismissal of CRP(MD)No.1248/2013. The Trial Court shall dispose of I.A.No.401/2014 within a period of three months from the date of receipt of a copy of this order. No costs. .
