List revised. Nobody is present on behalf of applicant. Sri K. R. Singh, learned Additional Chief Standing Counsel is present on behalf of opposite party.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 4.9.2018 passed in Writ Petition No.4281 of 2018.
An affidavit of compliance was filed by the opposite party. It is stated in para 5 of the affidavit of compliance that in respect of land in question a report was sent by the Tehsildar, Sadar on 13.2.2019. It is further stated that against the illegal possession Case No.59/73 year 2016-17 under Section 122-B of U.P.Z.A. & L.R. Act was filed before the Tehsildar, Sadar, who passed the order dated 28.06.2017 after hearing the parties in accordance with law. Being aggrieved against the order dated 28.06.2017 a revision was preferred which was admitted and order dated 28.06.2017 was quashed on 22.11.2017.
In this view of the matter, Cour is of the opinion that no further order is required to be passed in so far as the present contempt petition is concerned.
Accordingly, present contempt application is dismissed.
