The present application under Section 482 Cr.P.C. has been filed by the applicant with the prayer to quash the impugned order dated 5.10.2018 passed by Judge, Additional Court, Bijnor in complaint case no. 402 of 2017 (Shishpal Vs. Prahlad Singh) under Section 138 Negotiable Instruments Act, Police Station Chandpur, District Bijnor. Further prayer has been made to stay the entire proceedings of aforesaid complaint case.
Heard learned counsel for the applicant and the learned AGA appearing for the State.
Vide order dated 22.9.2018, non-bailable warrant was issued against the applicant in the proceedings under Section 138 Negotiable Instruments Act at the stage of recording the statement under section 313 Cr.P.C. Learned counsel for the applicant submits that applicant will appear before the court concerned within 15 days from today to cooperate the trial court.
In view of the above, this application is disposed of at this stage itself with the direction to the applicant to appear before the court concerned within 15 days from today. In case the applicant appears and his statement is recorded under section 313 Cr.P.C. and he moves an application for recall of order of non-bailable warrant, same shall be considered by the court concerned.
The application stands disposed of.
