Heard learned counsel for the applicant.
In the interest of justice, the delay in filing the revision is condoned without issuing notice to the opposite party.
The revision is directed against the order dated 08.11.2018 passed by the Civil Judge (Senior Division)/ Fast Track Court, Jhansi in Original Suit No.445 of 2012.
By the order impugned, deficiency of Court fee of Rs.1,87,945/- has been found in the suit for declaring a will to be void.
In my considered opinion, against the order impugned, an appeal under Section 6A of the Court Fees Act lies. Therefore, the instant revision under Section 115 CPC. is not maintainable.
Accordingly, the revision is dismissed, as not maintainable.
