Heard the learned counsel for the applicant.
By means of the present application under Section 12 of Contempt of Courts Act, 1971, non-compliance of the orders dated 12.04.2018 and 26.04.2018 passed in Writ-B No.3462 of 2018 and Writ-B No.3621 of 2018, respectively, is complained of.
It is argued by the learned counsel for the applicant that the Deputy Director of Consolidation has allowed his revision vide order dated 09.03.2018 which has been stayed by the High Court, and submits that now taking the advantage of the stay order they are raising constructions which will amount to violation of the order of the High Court.
In the considered opinion of this Court the Deputy Director of Consolidation's order has come to be stayed by the High Court without any further order of status quo, it cannot be said that the opposite party cannot raise constructions and if there is any construction in violation of any Act or Rule, it is open for the applicant to move an appropriate application in the pending writ petition and seek interim protection, if he is so advised.
There is no such act which can be said to be showing deliberate and wilful disobedience to the order of this Court.
The application stands dismissed and consigned to the records.
