Heard Sri Shivakant Awasthi, learned counsel for the applicants and Sri Ashish Pandey, learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashing the order dated 30.11.2017 passed by C.J.M. Bhadohi/Gyanpur in Case No. 857 of 2017, arising out of Case Crime No. 384/2016, u/s 323, 325, 427, 504, 506 IPC, police station Gopiganj, District Bhadohi pending in the court of C.J.M. Bhadohi.
It has been argued by learned counsel for the applicants that the applicants had approached this Court earlier for quashing of the charge-sheet and the said petition was disposed of by this Court with the direction to file discharge application before the court below. In pursuance of order of this Court, applicants filed discharge application and narrated all grounds before the court below. But the court below has not perused the record and rejected the discharge application of the applicants vide order dated 30.11.2017 which has been challenged in this petition.
After having heard the learned counsel for the parties present and perused the impugned order as well as the material brought on record, I am of the view that the impugned order is based upon relevant considerations and supported by cogent reasons, hence requires no interference by this Court in its inherent power under Section 482 Cr.P.C.
The application lacks merits and is accordingly dismissed.
