The written instructions submitted by Sri Ravi Prakash Pandey, learned counsel for the respondent-development authority are taken on record.
In the written instructions, it is sought to be submitted that the plot in question is available and is in the possession of the Varanasi Development Authority. There is no change in the plot in question in the revised layout plan. The total area of the plot allotted to the petitioner in the advertisement was 97.50 sq.meter, which has now become 97.55 sq. meter after completion of the scheme.
It is contended that the development authority is ready to execute the sale deed in case the petitioner cooperates.
Having noticed the above, without entering into the merits of the claim, the writ petition is being disposed of with the observation that it is open for the petitioner to approach the Varanasi Development Authority for execution of the sale deed of the plot in question and complete all the necessary formalities for the same. The Varanasi Development Authority shall be under obligation to do the needful in accordance with law, in case, the petitioner approaches the Varanasi Development Authority for execution of the sale deed. In case of any dispute or doubt to the petitioner regarding the layout or the location of the plot in question, it is open for him to seek refund of the money deposited by him.
