Sri Raj Mohan Yadav, learned counsel holding brief of Sri Ramesh Chandra Dwivedi, learned counsel for the petitioner, submits that the petitioner has made an application for a copy of the answer-books, in the subjects of Mathematics and Physics, in the Intermediate Examination, 2019. The only prayer, made by Sri Raj Mohan Yadav, learned counsel holding brief of Sri Ramesh Chandra Dwivedi, learned counsel for the petitioner, is that the application, may be decided within a stipulated period of time.
Learned Standing Counsel, submits that the respondent-Board, is under obligation of law, to decide the application, submitted in the prescribed format, after deposit of requisite fee.
No useful purpose will be served by keeping the petition pending.
The matter is remitted to respondent No.2-Secretary, Board of High School and Intermediate U.P. Allahabad/Prayagraj.
A writ of mandamus is issued, commanding the respondent No.2-Secretary, Board of High School and Intermediate U.P. Allahabad/Prayagraj, to decide the representation of the petitioner, for copy of her answer-sheets, in the subjects of Mathematics and Physics, in the Intermediate Examination, 2019, within a period of one month, from the date of, receipt of a certified copy of this order, along with a fresh copy of the application, in the prescribed format, and after deposit of requisite fee.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition, nor has judged the claim of the petitioner on merits. It is for the competent authority to do so with an independent application of mind.
With the aforesaid direction, the writ petition is finally disposed off.
