Learned Standing Counsel has appeared for respondents no.1 and 2.
Notice need not be issued to respondents no.3 to 6, at this stage. This writ petition has been filed with the following prayer:-
"Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide the Case No.04785 of 2020, Computerized Case No.T202014360104785 (Prabhavati versus Arun) under Section 35 of U.P. Revenue Code 2006, expeditiously as possible as within short stipulated period which is pending in the Court of Tehsildar, Shahganj, District-Jaunpur."
From perusal of record, it transpires that proceedings under Section 35 of U.P. Revenue Code, 2006 is pending consideration before respondent no.2. The limited prayer has been made for early disposal of the said proceedings.
Learned Standing Counsel does not oppose the limited prayer so made for early disposal of the proceedings.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no.2-Tehsildar, Shahganj, District-Jaunpur to decide the case of the petitioner, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
