Heard learned counsel for the parties.
The prayer made in the instant petition is for issuing direction to the court below to decide the application dated 13.03.2019 under Order 39 Rule 1 & 2 C.P..C. in Original Suit No. 216 of 2019 at the earliest possible.
The suit filed by the petitioners is against the State- respondents. The application filed by the petitioners under Section 80(2) C.P.C. has already been allowed by the trial court by the order dated 01.04.2019.
Counsel for the petitioners submitted that the defendants are not filing objections against the application for temporary injunction resulting in delay in its disposal.
Shri Chandra Shekhar Pandey, learned counsel appearing on behalf of respondent no. 2, states that the objections to the injunction application shall be filed without any further delay.
Accordingly, the instant petition is disposed of by directing the court below to make serious endeavour to decide the application for temporary injunction expeditiously, preferably within a period of eight weeks from the date of production of certified copy of this order.
