This application u/s 482 Cr.P.C. has been filed seeking the quashing of order dated 04.02.2019 passed by Principal Judge, Family Court, Pilibhit as well as the entire proceedings of Maintenance Suit No.150338 of 2018 (Dev Kumar vs. Pothiram), under sections 125 Cr.P.C., Police Station- Kotwali, District- Pilibhit.
Heard applicant's counsel and learned AGA. Entire record has been perused.
Counsel has not been able to point out any illegality, impropriety or incorrectness, much less than any abuse of court's process which may persuade this Court to interfere in the impugned order which reflects judicial application of mind. By the impugned order only Rs.2,000/- per month has been awarded to the wife/opposite party no.2 as a matter of maintenance which in the present days of high price rise cannot be said to be either excessive or disproportionate in fact, it appears to be on the lower side. The facts and circumstances of the case have been gone into by the Court below and there is no good reason to interfere in the same.
The application lacks merit and stands dismissed.
