Heard learned counsel for the petitioners, learned AGA for the State-respondents The present writ petition has been filed by the petitioners praying for quashing of the first information report registered as Case Crime No.584 of 2019 under Sections 419, 420, 467, 468, 471 IPC Police Station Meja, District Prayagraj and further to direct the respondents not to arrest the petitioners during pendency of investigation of the said case.
It is submitted by learned counsel for the petitioners that after lodging of the impugned first information report, there has been a settlement between the petitioners and respondent No.4.
Sri R. B. Singh has entered appearance on behalf of respondent No.4. He admit that the parties have settled their dispute amicably and settlement was made in writing, a copy whereof has been brought on record as Annexure 2. He submitted that the petitioners be permitted to file compromise before the investigating officer, who may do needful in the matter.
Learned AGA also makes the same submission.
Accordingly, the writ petition is disposed of by providing that the petitioners shall file the settlement in question before the second respondent along with a true attested copy of the instant order. The second respondent shall forward the same to the investigation officer. The investigating officer after due verification of the settlement, shall proceed to take further action in the matter in relation to submission of report under Section 173(2) Cr.P.C. within next six weeks.
