Heard learned counsel for the applicant, Sri Rakesh Pande, learned Senior counsel appearing for the informant and Sri Om Prakash, learned AGA.
Learned counsel for the applicant contends that a private agreement which has been relied upon cannot possibly form the basis for invocation of the provisions of the IPC. where allegations of misappropriation, cheating and forgery are alleged.
The Court finds itself unable to countenance the prayer of the applicant for anticipatory bail bearing in mind the seriousness of the allegations made in the FIR.
The application is dismissed.
