This writ petition has been filed praying for expediting of P.A. Case No. 69 of 2015 (Smt. Poonam Rastogi vs. Smt. Chitra Rastogi) said to be pending before the Prescribed Authority / Judge Small Causes Court, Meerut.
Learned counsel for the petitioner submits that the landlord filed a Release Application under Section 21(1)(a) of U.P. Act No. 13 of 1972 in November 2015.
The respondent / tenant filed written statement in April 2016 to which a replication was filed by the landlord in July 2016. Since, July 2016 when pleadings have been completed, the aforesaid Release Application is pending disposal before the Prescribed Authority.
As per sub-rule 3 of Rule 15 of the Rules framed under the Act, the Release Application should be decided within a period of two months from the date of its presentation, but the aforesaid Release Application is pending for the past three years.
Accordingly, this writ petition is disposed of with a direction to the Prescribed Authority to consider and decide the Release Application on its merit within a period of two months from the date a certified copy of this order is produced before him.
