The applicant has invoked the jurisdiction of this Court under section 482 Cr.P.C. with a prayer to direct Principal Judge, Family Court, Azamgarh to decide the case no. 246 of 2020, Pooja Bharti Vs. Ashish, under section 125 Cr.P.C.
P.S. Gambhirpur, District Azamgarh within the stipulated period..
Learned counsel for the applicant has submitted that the applicant is the wife of O.P. No.2 and she has filed an application for grant of maintenance under section 125 Cr.P.C. which is pending disposal since 17.3.2020 and has not been decided till date and the case has been lingering- on, on one pretext or the other.
In view of above, the court below is expected to make all endeavour to decide the aforesaid case expeditiously preferably within a period of four months after giving opportunity of hearing to both the sides and without giving unnecessary adjournments to either side and there is no other legal impediment in deciding the case.
With these observations, the present application u/s 482 Cr.P.C. stands disposed of.
