Madras High Court|07 June, 2017

JUDGMENT / ORDER

This Writ petition has been filed by the petitioner for issuance of a Writ of Mandamus, directing the respondents herein to select the petitioner to the post of Noon Meal Organizer based on the interview conducted on 18.05.2017 by the second respondent herein in pursuance of the call letter, dated 03.04.2017 in Na.Ka. No.1596/16/A5 and also appoint the petitioner on compassionate basis.
2. Heard, Mr.A.Saravanan, learned counsel appearing for the petitioner and Mr.J.Gunaseelan Muthaiah, learned Government Advocate appearing for the first respondent and Mr.A.Muthukaruppan, learned Additional Government Pleader appearing for the second respondent.
3. Mr.J.Gunaseelan Muthaiah, learned Government Advocate takes notice for the first respondent and Mr.A.Muthukaruppan, learned Additional Government Pleader takes notice for the second respondent. By consent, the Writ petition itself is taken up for final disposal.
4. The learned counsel for the petitioner stated that the petitioner is entitled to get appointment to the post of Noon Meal Organizer on compassionate ground.
5. The fact that the petitioner's mother died in the year 1996, when she was working as Noon Meal Organizer, is admitted by the petitioner. Though the petitioner's mother died in the year 1996, the petitioner has made a representation only on 15.05.2017, requesting the first respondent/District Collector to give her, preference to the post of Noon Meal Organizer. Based on her representation, she seeks compassionate appointment. The petitioner is also married. The date of the death of the mother of the petitioner was in the year 1996. The representation was made in the year 2017 is beyond the period prescribed by the rules. Even if the petitioner was a minor at the time of her mother's death, that can not justify, the application filed after the period of 20 years. Hence, there is no merits in this Writ petition and the same is dismissed. However, it is open to the petitioner to file an application for appointment after satisfying the norms prescribed by the respondents for the post, if she is eligible, pursuant to the recruitment Notification issued by the respondents. No costs.
