P.Kumar vs V.Roopa

Madras High Court|10 November, 2017

JUDGMENT / ORDER

This revision petition has been filed to issue a direction directing the learned Sub Judge, Pudukottai, to dispose the petition in HMOP.No.284 of 2013 within a time frame to be fixed by this Court.
2.Learned counsel for the petitioner would aver that the petitioner filed a divorce petition in HMOP.No.284 of 2013 before the Sub Court, Pudukottai which has been periodically adjourned for filing counter by the respondent and for the past four years, the respondent has not filed counter. Further, the matrimonial relationship between the parties are not cohabited from 2008 onwards. Since the HMOP is pending for the past four years without any progress, the petitioner has come forward with this revision.
3.Since it is only a petition for early disposal of HMOP, no notice is necessary to the respondents.
4.Considering the facts and circumstances of the case and without going into the merits of the matter, this Court feels that ends of justice would be met by directing the Court below to dispose of the HMOP which is of the year 2013 within a time frame. Accordingly, the learned Sub Judge, Pudukottai, is directed to dispose of the HMOP.No.284 of 2013 in accordance with law within a period of six months from the date of receipt of a copy of this order.
With the above direction, this Civil Revision Petition is disposed of. No costs.
To The Sub Judge, Pudukottai.
