This Revision Petition has been filed to dispose of O.S.No.138 of 2015 on the file of the District Munsif Court, Nilakkotai, within a time frame to be fixed by this Court.
2.According to the revision petitioner, the suit was filed by the respondents herein for injunction restraining the revision petitioner herein from disturbing peaceful possession and enjoyment of the suit property which is a cart track running East to West between Survey Nos.527 and 524 and then runs in the north direction to reach Survey No.525.
3.The allegation of the revision petitioner is that after getting an order of status-quo in I.A.No.577 of 2015, the plaintiffs are not interested in pursuing the case and the Trial Court also has not commenced the trial in spite of completion of pleadings and framing of issues.
4.Private Notice was ordered returnable by 01.06.2017. The respondents have received the notice, but not entered appearance.
5.The grievance of the petitioner is that the issues in this case were framed on 03.06.2016 and even after 11 months, the trial has not commenced.
6.I find merit in the said submission and the grievance of the revision petitioner can be redressed by directing the Trial Court to dispose of the suit within a time frame.
7.Accordingly, this Civil Revision Petition is disposed of directing the Trial Court to dispose of the suit in O.S.No.138 of 2015 on the file of the District Munsif, Nilakkotai, within a period of four months from the date of receipt of a copy of this order. No costs.
