JUDGMENT / ORDER

Rule. Mr.Nanavati, learned APP appears and waives service of rule for respondent - State.
The instant application is filed seeking temporary bail for 30 days in connection with Rander police station, Dist.Surat C.R.No.I - 2 of 2009 on account of the fact that the wife of the applicant delivered pre-matured child and the child is in critical condition and is in incubator.
Having considered the submissions advanced on behalf of both the sides, so also considering the medical papers on record, this Court is of the opinion that the application deserves to be allowed in part.
The application is partly allowed and the applicant is ordered to be released on temporary bail for the period of two weeks from the date of his actual release on his furnishing personal bond of Rs.10000/- (Rupees ten thousand only) with one surety of the like amount to the satisfaction of the concerned jail authority. Upon completion of period of temporary bail, the applicant shall immediately surrender before the concerned jail authority.
Rule is made absolute to the aforesaid extent. D.S.P.
