This petition under Articles 226 and 227 of the Constitution of India is filed against no order passed by the learned Magistrate on an application preferred by the petitioner herein under the provisions of Protection of Women from Domestic Violence Act, 2005 in an application under Section 12.
It is not in dispute that learned Magistrate has kept the hearing of the case on 12.1.2012 and further the exercise of powers under Section 12 and other provisions of the Act, 2005 is within exclusive domain of learned Magistrate and at this stage this Court would not like to exercise powers as prayed for and in absence of merit this petition is rejected.
