This petition has been preferred seeking a direction for the promotion of the petitioner to the post of Administrative Officer.
The petitioner has admittedly attained the age of superannuation. He was however terminated from service on 16 September 2006. This order of termination was assailed by way of a writ petition being Writ-A No. 29084 of 2007 which was ultimately allowed on 07 February 2012 in the following terms:-
"Therefore, the writ petition is allowed and the order of termination is set aside treating the petitioner to be in service at the time of his superannuation. The respondents may choose to impose a minor punishment on the petitioner, provided it is permissible under the Rules to do so, in view of the fact that the petitioner has already retired from the service. This decision exclusively lies with the respondents. "
As is evident from the operative directions issued, the petitioner was not granted any consequential benefits pursuant to the order of termination being set aside.
In view of the above, the relief as sought cannot possibly be granted.
Writ petition is dismissed.
