This application u/s 482 Cr.P.C. has been filed seeking the direction to the court below concerned to decide the Sessions Trial No. 587 of 2014 (State vs. Phool Kunwar and others) in case crime no. 410 of 2012, u/s 452, 307, 323, 504, 506/34 IPC, P.S. Kavi Nagar, District Ghaziabad, pending in the court of Additional District & Session Judge, Court no. 15, Ghaziabad.
Heard applicants' counsel and learned A.G.A. for the State. Record has been perused.
It is submitted that the applicant is facing trail since 2014 and he is in jail. It is stated that this is first application, no such application has been filed prior to it regarding same relief, it is stated that till date only two witnesses have been examined.
In the facts and circumstances of the case the lower court concerned is directed to expedite and conclude the proceeding of the aforesaid case preferably within a period of one year from the date of production of the certified copy of the order without granting any unnecessary adjournment to either of the parties, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
With the aforesaid observation this application is disposed off.
