P.Chandira vs The Chairman-Cum-Managing ...

Madras High Court|06 January, 2017

JUDGMENT / ORDER

The petitioner claims to be one of the shareholders of M/s.Neyveli Lignite Corporation, Neyveli [in short NLC] and her husband is working as Chief Manager in the services of the said Corporation. The petitioner/Party-in-Person would submit that the respondents had recently called for recruitment through issuance of advertisement for selection to the post of General Manager (Mechanical and Civil) and Deputy General Manager (Mechanical, Electrical and Civil). The grievance expressed by the petitioner is that the respondents had indulged in a wrongful manner by omitting the seniority list by not selecting the in-service candidates and going through direct recruitment by issuing advertisement. The petitioner/Party-in-Person would submit that on account of issuance of advertisement and selection process, NLC is bound to suffer huge loss and therefore, she has got locus standi to maintain the writ petition.
2. This Court has considered the submissions of the petitioner/Party-in-Person and also perused the materials placed before it.
3. Registry has raised objection as to the maintainability of the writ petition and returned the papers and the petitioner/Party-in-Person made the following endorsement:
I am one of the share holder of the company. The huge loss to the company. Hence maintainability before the service court to post the case.
4. It is a well settled position of law that in service matter, aggrieved person alone can make a challenge to the selection process. Admittedly, the petitioner is not even an employee of NLC and by virtue of her claim that she being a shareholder, sought to challenge the selection process. In the considered opinion of the Court, the petitioner has no locus standi to make a challenge to the selection process being done by NLC and therefore, she cannot maintain the writ petition.
5. Hence, W.P.No.SR32785 of 2016 is rejected.
