O R D E R :
This Civil Revision Petition is directed against the order dated 16-11-2009 passed in I.A.No. 354 of 2009 in I.A.No. 144 of 2009 in OS.No. 30 of 2009 by the Junior Civil Judge, Kothavalasa, Vizianagaram district, wherein the said application filed by the respondent-defendant under Order-XIX Rule 1 of CPC for appointment of a Commissioner to make local inspection of the suit property was allowed and an Advocate-Commissioner was appointed.
2. It is stated by the learned counsel for the respondents that the Advocate-Commissioner has since inspected the suit property and also filed his report and the arguments in the temporary injunction petition, I.A.No.144 of 2009 are in progress.
3. As the Advocate-Commissioner has already inspected the suit property and filed his report and warrant stands executed, the present Civil Revision Petition has become infructuous.
4. In the circumstances and in view of the above submission, the Civil Revision Petition is dismissed as having become infructuous. No costs.
