(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred by the applicant convict for temporary bail on the ground that his sister has expired.
We may state that initially it was on the ground to look after the agricultural work of the family, but subsequently, the ground is added for the death of his sister and the death certificate is also produced.
Pursuant to the earlier order passed by this Court, learned APP under the instructions received by him from Mangrol Police Station states that the ground of death of the sister is genuine. The jail report shows that earlier after he was reported absconding, he was released on temporary bail and he has surrendered in time. No other adverse circumstances are brought to the notice of this Court.
Under the circumstances, the applicant be released on temporary bail for a period of 10 days from the actual release on personal bond of Rs.5000 and one surety of like amount with the further direction that upon expiry of the period, he shall surrender with the jail authority.
Application allowed to the aforesaid extent. Rule made absolute accordingly. D.S today.
